SCRATCHER PROMOTION RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

The March and Ash Scratcher Promotion ("Promotion") begins at 6:00:00 AM Pacific Time (“PST”) on April 21, 2025, and ends at 10:00 PM PST on May 19, 2025. (“Promotion Period”). The computer clock of the Administrator is the official time-keeping device in the Promotion.

1. ELIGIBILITY: The Promotion is open only to customers 21 years of age and over (or 18+ with a valid medical cannabis recommendation) at the time of Promotion participation. By participating, you agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects. Void in any state not listed above and where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.

2. HOW TO PARTICIPATE: Make a purchase at any March and Ash store and you will receive a scratcher card (“Scratcher”). No purchase is required to receive a Scratcher. If you would like a Scratcher without making a purchase, please visit a participating store during the promotion period and request one from a staff member. One Scratcher per customer, per day, applies regardless of the number of purchases. All Scratchers must be submitted to the Administrator no later than 10:00 PM PST on May 19, 2025. Failure to do so may result in forfeiture of the coupon.

3. SCRATCHER ODDS: A total of 25,000 Scratchers are available to be awarded during the Promotion by randomly distributing Scratchers during the Promotion Period as described above.

4. SCRATCHER RESTRICTIONS: Scratchers have no cash value and cannot be redeemed for cash. Scratchers are not applicable toward Puffco, Focus V (Carta) and My Bud Vase purchases. Scratchers expire on May 19, at 10:00 PM PST. Scratchers can be combined with other sales and member group discounts. Scratcher must be used in full during your next purchase—any unused portion will not carry over to future transactions. Scratchers are not redeemable the same day as receipt and must be redeemed on the customer's next purchase. Customers redeeming a Scratcher may not receive an additional Scratcher on that transaction. Scratchers can only be redeemed in-store and cannot be used for online purchases. Redemption of scratcher requires a minimum $5 purchase. A valid government ID must be presented at the time of redemption to verify your age and identity. Scratchers are not valid at the Imperial Beach location. Customers may only use scratcher per transaction. Multiple scratcher discounts cannot be combined (e.g., three $5 scratchers cannot be used together for $15 off). March and Ash is not responsible for lost, stolen, or damaged scratchers. March and Ash reserves the right to modify or cancel the Scratcher promotion at any time without prior notice.

5. GENERAL CONDITIONS: By participating, you agree that prize provider March and Ash, Inc. and their respective subsidiaries, affiliates, directors, employees, agents, successors and/or assigns and their advertising and promotional agencies shall have no liability for, and to release and hold all such parties harmless from, any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Promotion. Sponsor reserves the right, in its sole discretion to terminate, modify, cancel or suspend this Promotion and award prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the game. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right at its sole discretion, to disqualify any individual, and all of his/her entries, who tampers with the entry process or promotion game play. Acceptance of Scratcher or any prize constitutes permission to use the winner's name, photograph and likeness for publicity purposes without further compensation in any and all media now known or hereinafter without territorial restriction (except where prohibited by law).

6. RELEASE OF LIABILITY: By entering the Promotion, you agree: (i) to be bound by these official rules and by all applicable laws and all decisions of the judges which shall be binding and final; (ii) to waive any rights to claim ambiguity with respect to the official rules; (iii) to waive all of his/her rights to bring any claim, action, or proceeding against any of the Sponsor; and (iv) to release, indemnify, and hold harmless each of the Sponsor, March and Ash, Inc., and each of their respective officers, directors, employees, agents and representatives, from any liability (including, but not limited to, liability for any property loss, damage, personal injury, bodily injury, death, loss, expense, accident, delay, inconvenience or irregularity), costs and expenses (including without limitation, reasonable outside attorney’s fees) that may arise in connection with: (a) your participation or inability to participate in the Promotion, (b) typographical errors in the official rules or any Promotion promotional materials, (c) acceptance or possession, defects in, use, misuse or inability to use an prize (or any component thereof), (d) any change by any company or any other person providing any of the components of a prize due to reasons beyond any of the Sponsor’ control or as otherwise permitted hereunder, (e) any interruptions in or postponement, cancellation, or modification of the Promotion, (f) human error, (g) incorrect or inaccurate transcription, receipt or transmission of any part of the Entry (including, without limitation, the entry information or any parts thereof), (h) any technical malfunctions or unavailability of the Promotion site or any mobile or cellular component, telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by any of the Sponsor or by you, (i) interruption or inability to access the sweepstakes, any Promotion-related web pages, mobile or cellular component, or any online service via the internet due to hardware or software compatibility problems, (j) any damage to your (or any third person’s) mobile device, computer and/or its contents related to or resulting from any part of the Promotion, (k) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions, (l) any wrongful, negligent, or unauthorized act or omissions on the part of any of the Sponsor, or any of their agents or employees, or (m) any other cause, condition or event whatsoever beyond the control of any one or more of the Sponsor. Each winner hereby acknowledges that the Sponsor have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize or component thereof, including any express or implied warranties provided by any of the prize suppliers associated with this Promotion.

7. CHOICE OF LAW AND JURISDICTION: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules, or the rights and obligations of entrants or winners, Sponsor, and Administrator in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions. Any action seeking legal or equitable relief arising out of or relating to the Promotion or these Rules shall be brought only in the courts of the State of California. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction you may have. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

8. ARBITRATION AND DAMAGES: By participating, you agree that any and all disputes, claims and causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorney's fees.
